Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of holistique.com, our IV Lounge booking pages, our supplement shop at shop.holistique.com, and any other digital services we provide (collectively, the “Service”), all operated by Holistique Medical Center (“Holistique,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

The Service is intended for adults age 18 or older. By using the Service, you represent that you are at least 18, that the information you provide is accurate and complete, and that you will keep it current.

2. Medical Disclaimer

The content on the Service — including articles, descriptions of therapies, IV menus, product descriptions, and educational materials — is for general informational purposes only. It is not medical advice, diagnosis, or treatment, and it does not establish a patient-provider relationship. Always seek the advice of a qualified licensed healthcare professional with any questions you have about a medical condition, and never disregard professional medical advice or delay seeking it because of something you read here.

Statements about products, supplements, and certain therapies described on the Service have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.

3. Appointments & Bookings

Requests submitted through forms on the Service (including New Patient intake, Request Appointment, IV bookings, and event registration) are requests only and do not constitute confirmed appointments until our team contacts you. Scheduling, rescheduling, cancellation, and no-show rules are described in our Office & Financial Policy.

When you use our patient portal or any third-party booking tool we link to, your use is also governed by that provider’s terms.

4. Accounts

Some parts of the Service require you to create an account (for example, the patient portal, or the supplement shop). You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to notify us promptly of any unauthorized use.

5. Shop & E-Commerce

Orders & pricing

Our supplement shop at shop.holistique.com displays product descriptions, pricing, and availability that may change at any time without notice. Submitting an order is an offer to purchase; we may accept, decline, cancel, or limit your order, including for suspected error, fraud, or stock unavailability. Prices are in U.S. dollars and exclude applicable sales tax, which is calculated at checkout.

Payment

Payment is processed by a PCI-compliant third-party payment processor. By placing an order, you authorize us (and our processor) to charge your selected payment method for the order total, including tax and shipping.

Shipping

We ship to addresses inside the United States unless otherwise stated. Risk of loss and title pass to you on delivery to the carrier. Estimated delivery times are not guaranteed.

Returns & refunds

Because we sell health products, some items are non-returnable for safety reasons. Eligibility and instructions for returns and refunds are described on the shop and in any return policy posted there at the time of your purchase. Damaged or incorrect items should be reported within 14 days of delivery.

Product information

Statements about the supplements, devices, and lab kits we sell are not approved by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent disease. Consult your healthcare provider before starting any supplement, especially if you are pregnant, nursing, taking medications, or have a medical condition.

6. SMS Messaging Terms

If you opt in to receive SMS text messages from Holistique by checking the SMS consent checkbox on a website form, the following terms apply.

• Program description. Transactional messages for appointment scheduling, confirmations, reminders, rescheduling, follow-up, and patient onboarding.
• Message frequency. Varies based on your interaction with our clinic.
• Rates. Message and data rates may apply.
• Opt out. Reply STOP at any time. You’ll receive a confirmation and no further messages will be sent.
• Help. Reply HELP, or contact us at /contact-us.
• Carriers. Carriers are not liable for delayed or undelivered messages.
• Privacy. See our Privacy Policy for how we handle mobile information. Mobile numbers and SMS opt-in are never shared for third-party marketing.

SMS consent is opt-in and is not a condition of receiving care or making a purchase.

7. Acceptable Use

You agree not to:

• Use the Service in violation of any law or in a way that infringes another person’s rights.
• Attempt to gain unauthorized access to the Service or to other users’ accounts or data.
• Interfere with the Service’s security or operation, including by introducing malware or by scraping at a rate or scale that disrupts the Service.
• Submit content that is false, defamatory, harassing, or that contains another person’s health or personal information without permission.

8. User Content

If you submit reviews, testimonials, photos, or other content to the Service, you grant Holistique a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with operating and promoting the Service. You represent that you own or have the rights to share the content and that it does not violate another person’s rights or any law.

9. Intellectual Property

The Service and its content — including text, graphics, logos, images, the Holistique name and marks, and the underlying software — are owned by Holistique Medical Center or its licensors and are protected by U.S. and international copyright, trademark, and other laws. Except for content you may print or save for your own personal, non-commercial use, no part of the Service may be reproduced, distributed, or used without our prior written permission.

10. Third-Party Links

The Service may link to third-party websites, applications, or services that we do not control, including our patient portal, supplement shop, lab kit vendors, and social media. We are not responsible for their content, practices, or terms, and your use of those sites is at your own risk.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLISTIQUE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless Holistique Medical Center and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, or your breach of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for any breach of these Terms. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The state and federal courts located in King County, Washington have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date at the top, and for material changes we may provide additional notice through the Service or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
